QwikCut, LLC (“QwikCut,” “we,” “us,” or “our”) provides sports video, analytics, storage, recruiting, camera, support, and related services through our websites, applications, and authenticated platform (collectively, the “Services”). This Privacy Policy explains how we collect, use, disclose, and protect Personal Data and the choices and rights that may apply.

1. Our Role in Processing Personal Data

QwikCut may act as either a Controller or a Processor depending on the processing activity.

QwikCut as Processor. When a school, club, league, association, team, or other customer provides or controls Personal Data through the QwikCut platform, including roster information, athlete or player information, video, statistics, and related Customer Content, the customer generally determines the purposes and means of that processing and QwikCut processes the Personal Data on the customer’s behalf. That processing is governed by the customer’s agreement with QwikCut and, where applicable, the QwikCut Data Processing Addendum (DPA) available at https://www.qwikcut.com/dpa/.

QwikCut as Controller. QwikCut acts as a Controller when it determines the purposes and means of processing for its own business activities, such as operating our public websites, managing business and customer contacts, account administration, billing, security, fraud prevention, support, legal compliance, and QwikCut’s own marketing activities. QwikCut may act as a Controller for a separate, permitted promotional use of public Customer Content, subject to applicable law and required permissions. A public video or highlight setting does not itself authorize QwikCut to publish other information about a minor or use a minor’s identity in its advertising.

2. Personal Data We Collect

• Contact and account information, such as name, email address, telephone number, organization, mailing address, username, and account identifiers.
• Team, roster, coach, athlete, and player information provided through the platform.
• Video, audio, images, highlights, statistics, game or event information, performance information, and other Customer Content.
• Support communications and information submitted through sales, demo, support, or other forms.
• Transaction and billing information. Payment card information may be provided directly to third-party payment processors rather than stored by QwikCut.
• Device, browser, IP address, usage, diagnostic, security, and log information.
• Cookie, analytics, advertising, and similar technology information collected on our public websites where those technologies are used.
• Location information where a QwikCut feature requests location and you permit access through your device or browser.

3. How We Use Personal Data

• Provide, operate, maintain, secure, support, and improve the Services.
• Create and administer accounts and provide requested platform functionality.
• Host, store, process, analyze, transmit, display, share, migrate, and delete Customer Content in accordance with customer instructions and platform settings.
• Provide customer service, technical support, statistics, analytics, recruiting, video, and related services.
• Process transactions and administer customer relationships.
• Detect, prevent, investigate, and address security incidents, fraud, misuse, and technical problems.
• Communicate about the Services, including service notices and, where permitted, sales or marketing communications.
• Analyze use of our public websites and measure or improve marketing activities.
• Comply with law, enforce agreements, and protect QwikCut, our customers, users, and others.

4. Customer Content, Privacy Settings, and Public Content

Customers control the privacy and sharing settings made available within the QwikCut platform. Content designated as private is processed as necessary to provide the Services and is not used by QwikCut for QwikCut marketing, advertising, or promotional purposes.

When a customer affirmatively designates a video or highlight as public, QwikCut may display that video or highlight according to the customer’s selected settings. QwikCut does not generally display minors’ personal profile or roster information publicly merely because a video or highlight is public. Any separate use of identifiable minors in QwikCut marketing or promotion requires the permissions and lawful basis applicable to that use; public status alone is not sufficient.

The authenticated QwikCut platform does not use third-party advertising or remarketing tracking to target users with advertising based on private Customer Content.

5. Youth and Minors

The QwikCut platform is used by schools, clubs, teams, leagues, and other organizations and may contain information relating to athletes or players under 18. When QwikCut processes minors’ Personal Data on behalf of a customer, the customer is responsible for determining the appropriate lawful basis and obtaining any notices, permissions, consents, or authorizations required by applicable law. QwikCut processes that information according to customer instructions and applicable contractual and security safeguards.

A customer may mark videos or highlights private through the available settings. QwikCut does not use private videos or highlights, or other private Customer Personal Data relating to minors, for QwikCut marketing or promotional purposes. Minors’ information is not generally displayed publicly simply because it has not been marked private; the public setting applies to the relevant video or highlight. A public setting alone does not authorize separate promotional use of a minor’s identity.

6. Cookies, Analytics, and Advertising on Public Websites

Our public websites may use cookies, analytics tools, advertising technologies, pixels, tags, and similar technologies to operate the websites, remember preferences, understand website use, measure campaigns, and support marketing. Depending on the technologies in use, these may include services provided by companies such as Google, Meta/Facebook, or X.

These public-website technologies are distinct from the authenticated QwikCut platform. Advertising and remarketing technologies described in this section are not used inside the authenticated platform to target users based on private Customer Content.

You may be able to control cookies through our website controls, browser settings, device settings, or choices provided by the applicable third-party service. California residents may also review QwikCut’s Do Not Sell or Share My Personal Information notice.

7. Legal Bases for EEA Processing

Where the GDPR applies and QwikCut acts as Controller, QwikCut processes Personal Data when necessary to perform a contract or take requested pre-contract steps, based on legitimate interests that are not overridden by applicable rights, with consent where required, or to comply with legal obligations. The applicable legal basis depends on the processing activity.

Where QwikCut acts as Processor, the applicable customer is responsible for establishing the lawful basis for the processing and QwikCut processes Personal Data on that customer’s documented instructions.

8. Service Providers and Subprocessors

QwikCut uses third parties to help operate and support the Services. For production platform Customer Personal Data, QwikCut uses cloud infrastructure and managed database providers for hosting, storage, and related services. Current authorized subprocessors and processing locations are described in the applicable DPA.

QwikCut may also use providers for business functions such as payment processing, website analytics, advertising, communications, and other corporate services when those providers are relevant to the applicable processing. Providers receive Personal Data only as appropriate for their services and are subject to applicable contractual and legal requirements.

9. International Data Transfers

QwikCut is based in the United States and Personal Data may be transferred to and processed in the United States. Production platform data is processed in the United States using the infrastructure and database providers identified in the applicable DPA.

For transfers of Customer Personal Data protected by the GDPR from the European Economic Area to QwikCut in the United States, QwikCut uses the transfer mechanism specified in its DPA. Where required, this includes the European Commission’s Standard Contractual Clauses, including Module Two for Controller-to-Processor transfers. QwikCut also maintains documented technical and organizational safeguards and a transfer impact assessment for applicable EEA transfers.

10. Security

QwikCut maintains technical and organizational measures designed to protect Personal Data. These include encryption of production Customer Personal Data in transit and at rest, multi-factor authentication for applicable access, role-based and user-based access controls, system logging and monitoring, backups, and restrictions on personnel access based on business need.

No method of transmission or storage is completely secure, and QwikCut cannot guarantee absolute security.

11. Retention and Deletion

QwikCut retains Personal Data for as long as reasonably necessary for the purposes for which it is processed, to provide the Services, meet contractual obligations, comply with law, resolve disputes, maintain security, and enforce agreements.

Where QwikCut processes Customer Personal Data as a Processor, retention and deletion are governed by customer instructions, the Agreement, and any applicable DPA. QwikCut can delete customer accounts, athlete data, and video in accordance with applicable instructions and processes. Backup copies may remain protected for a limited period until deleted or rendered inaccessible through the applicable backup lifecycle.

12. Disclosure of Personal Data

QwikCut may disclose Personal Data to service providers and subprocessors as described above; at a customer’s direction or through customer-selected sharing settings; in connection with a merger, acquisition, financing, reorganization, or sale of assets; or when QwikCut reasonably believes disclosure is required by law or valid legal process, necessary to protect rights or safety, or appropriate to investigate fraud, security incidents, or misuse.

QwikCut does not sell Personal Data for monetary compensation. Certain public-website advertising or analytics technologies may constitute “sharing” under some U.S. state privacy laws. Please review our Do Not Sell or Share My Personal Information notice for additional information and available choices.

13. Data Protection Rights

Depending on where you live and the law that applies, you may have rights to request access, correction, deletion, restriction, objection, portability, withdrawal of consent, or other rights concerning your Personal Data. We may need to verify your identity before completing certain requests.

If QwikCut acts as Controller for the Personal Data involved, you may submit the request directly to QwikCut. If QwikCut processes the Personal Data on behalf of a school, club, league, team, or other customer, that organization is generally the Controller and should be contacted first. QwikCut will reasonably assist the Controller with requests as required by applicable law and the DPA.

Individuals in the EEA also have the right to lodge a complaint with the competent data protection Supervisory Authority.

14. California and Other U.S. State Privacy Rights

Residents of California and certain other U.S. states may have additional privacy rights under applicable law, including rights relating to access, correction, deletion, portability, and certain sales or sharing of Personal Data. QwikCut’s Do Not Sell or Share My Personal Information notice provides additional information for California residents and instructions for submitting applicable requests.

15. Links to Other Sites

The Services may contain links to websites or services that QwikCut does not operate. QwikCut is not responsible for the privacy practices of those third parties. We encourage you to review their privacy notices before providing Personal Data.

16. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. We will post the updated policy on this page and update the effective date. Where required by law, we will provide additional notice of material changes.
